Acceptance of Terms

These Terms of Service are an agreement between you and Richdale Ventures LLC, which operates GhostShield VPN. By creating an account or using our apps, website or VPN servers, you agree to them. If you do not agree, please do not use the service. You must be at least 18 years old, or the age of majority where you live, or use the service with the permission of a parent or legal guardian.

The Service

GhostShield VPN provides encrypted VPN connections, servers in several countries, and related features such as threat and ad blocking, apps for supported devices and a browser extension. We keep improving the service, so features and server locations may change, and some may be unavailable from time to time for maintenance or reasons outside our control.

Your Account

• Give a valid email address and keep it up to date, because we use it to contact you about your account.
• Keep your password and sign-in codes safe. You are responsible for everything done through your account.
• Your plan is for your own use and members of your household.
• You can use the service on the number of devices included in your plan, as shown when you bought it or in your account.
• You may not sell, rent, transfer or publicly share your account, your plan, your activation code or your VPN configuration files.

Acceptable Use

You may not use GhostShield VPN, or let anyone else use your account, to:

• break any law or regulation that applies to you or to us;
• download, upload or share material that infringes copyright or other intellectual property, including pirated movies, TV shows, music, games or software, whether by torrent, other peer-to-peer software or any other method;
• create, send or host viruses, malware, ransomware or phishing pages;
• hack, scan, probe or attack other networks, systems or devices, or take part in denial-of-service attacks;
• send spam or bulk unsolicited messages, or run automated account creation, click fraud or similar abuse;
• commit fraud, including payment fraud or impersonating others;
• access, store or share child sexual abuse material, or harass, threaten or exploit anyone;
• run a public server, proxy or VPN service for others through our network, or resell access to it;
• get around device limits or trial rules, for example by creating several accounts;
• disrupt or overload our servers, or interfere with other customers’ use of the service.

Using peer-to-peer and file-sharing software is allowed for content you have the right to download and share.

Fair Use

Plans have no fixed data cap. GhostShield VPN is designed for personal use, and our servers are shared by all customers. If your use stays far above normal personal use for a sustained period, or puts our network, other customers or our hosting providers at risk, for example running servers, always-on bulk transfers or heavy seeding, we may contact you, limit your connection speed or suspend your account until the issue is resolved.

Copyright and Abuse Complaints

Our servers are hosted by data centre providers who pass on complaints about traffic through our network, such as copyright notices under the DMCA. We take these complaints seriously. When we can reasonably identify the account involved, we may warn, suspend or terminate it, and we terminate the accounts of repeat infringers. Handling a complaint does not involve monitoring or recording the websites you visit or the content of your traffic.

Plans, Payment and Billing

Subscription fees are billed in advance. You authorize us to charge your payment method for all fees associated with your account.

• Prices are shown before you buy. Taxes may be added where required by law.
• Plans bought through a partner or reseller are activated with a code. Each code can be used once, is linked to the account that redeems it and cannot be resold or transferred.
• A lifetime plan lasts for as long as GhostShield VPN is offered and your account is in good standing. It is not tied to the lifetime of a person, a device or the partner who sold it.

Free Trials

• One free trial per person. A trial is linked to your email address and your payment card; an email address or card that has already been used for a trial cannot start another one.
• The length of the trial and what happens when it ends are shown before you start it.
• Using several accounts, email addresses or cards to get repeated trials is not allowed. We may end such trials and close the accounts involved.

Auto-Renewing Subscriptions

GhostShield plans are auto-renewing subscriptions. By subscribing, you agree to the following:

• Your subscription renews automatically at the end of each billing period for another period of the same length, at the price of your plan, unless you cancel before the renewal date.
• If you start a free trial with a card on our website, your paid subscription begins when the trial ends and your card is charged then, unless you cancel before the trial ends.
• You can cancel at any time. Cancelling stops the next renewal; you keep access until the end of the period you have already paid for.
• Subscriptions bought on our website are billed by Stripe and can be managed or cancelled from your account dashboard.

Subscriptions Purchased Through Apple

If you subscribe in the GhostShield app for iPhone or iPad, your subscription is sold and billed by Apple through your Apple Account, and these terms also apply:

• Payment is charged to your Apple Account when you confirm the purchase. If you start a free trial, you are charged when the trial ends instead.
• The app may offer new subscribers a free trial. When it ends, your subscription continues at the price shown and your Apple Account is charged, unless you cancel at least 24 hours before the trial ends. Any unused part of a free trial ends if you buy another subscription.
• Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your Apple Account is charged for the renewal within the 24 hours before the current period ends.
• You can manage or cancel your subscription in your Apple Account settings (Settings > your name > Subscriptions). Deleting the app does not cancel the subscription.
• Apple handles billing and refunds for App Store purchases. To request a refund, visit reportaproblem.apple.com.
• These Terms are between you and GhostShield, not Apple. Apple is not responsible for the GhostShield app or its content, maintenance, support, warranties, or any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Refund Policy

We offer a 30-day money-back guarantee on plans bought on our website. If you are not satisfied, contact us within 30 days of your first purchase for a full refund.

• App Store purchases are refunded by Apple (see the section above).
• Plans bought through a partner or reseller are refunded by that seller under its own refund policy.
• Refunds may be declined for accounts suspended or terminated for violating these Terms, unless the law requires otherwise.

Suspension and Termination

If you break these Terms, or if your use creates a legal, security or technical risk for the service, our customers or our providers, we may:

• send you a warning;
• limit your connection, for example its speed or the servers you can use;
• suspend your account;
• terminate your account and end your plan.

We may act immediately and without warning for serious violations, such as illegal activity, copyright complaints, fraud or security threats. When we suspend or terminate an account, we tell the account holder by email where we can, and you can reply with any questions. You can stop using the service, cancel your subscription or delete your account at any time.

Privacy

Our Privacy Policy explains what we collect and what we never log. Enforcing these Terms does not involve monitoring or recording the websites you visit or the content of your traffic.

Disclaimer and Limitation of Liability

GhostShield VPN is provided “as is” and “as available”. We work hard to keep it fast and secure, but we do not guarantee that it will be uninterrupted or error-free, available in every country or on every network, or able to make you anonymous in all situations. To the fullest extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection law that cannot be waived.

Changes to These Terms

We may update these Terms from time to time. The date at the top of this page shows when they last changed. For important changes, we will tell you by email or in the app before they take effect. If you keep using the service after that, the updated Terms apply.
